General terms and conditions of business

1. Scope

Our following terms and conditions apply exclusively to the contract concluded between us and the consumer (customer) in the SEMO online shop for the delivery of goods.

2. Contracting parties, conclusion of contract

The purchase agreement is concluded with Trigon Deutschland GmbH.

The presentation of products in our online shop does not constitute a legally binding offer, but rather an invitation to submit a binding offer to us. You can initially place our items in a virtual shopping cart without obligation and subsequently modify your order. Only by clicking the "Buy Now" button is the order completed and the purchase contract concluded. You will receive an email confirming your order. All offers are valid while stocks last.

3. Delivery

We currently deliver to the following countries:

Germany, delivery time: approx. 1-3 working days

Belgium, Netherlands, Luxembourg, Austria, delivery time: approx. 3-4 working days

France, Spain, Italy, Poland, delivery time: approx. 5-6 working days

Other EU countries: approx. 7-9 working days

In addition to the stated costs, we charge shipping costs for the respective country:

Germany: 5.90 euros

Belgium, Netherlands, Luxembourg, Austria: 10,- Euro

France, Spain, Italy, Poland: 15 euros

Other EU countries: €25

4. Payment options

The following payment methods are available for purchases in the Wildorchard online shop:

5. Retention of title

The purchased item remains our property until full payment is received.

6. Liability

6.1
We are liable without limitation for intent and gross negligence. In cases of slight negligence, our liability is limited to foreseeable damages typical of this type of contract. We are not liable for the slightly negligent breach of ancillary contractual obligations that are not essential. 6.2
Liability for fraudulent concealment of defects or for the assumption of a guarantee of quality, as well as liability for claims under the Product Liability Act and for damages resulting from injury to life, body, or health, remains unaffected. This does not entail any shift in the burden of proof to the detriment of the customer.

6.3
No liability is assumed for damages resulting from improper handling, processing or natural wear and tear.

6.4
The customer must grant us, after scheduling an appointment, the appropriate time and opportunity to carry out remedial work and replacement deliveries.

6.5
Before withdrawing from the contract or reducing the price, the customer is obliged to give us a reasonable period for subsequent performance.

6.6
To the extent that our liability is excluded or limited, this also applies to the personal liability of our employees, workers, staff, representatives and agents.

6.7
If we are liable for damages due to a breach of duty that gives rise to a claim for damages in lieu of performance within the meaning of Sections 281, 282, 284 of the German Civil Code (BGB) or due to a tort, such damages shall be limited to a maximum of the agreed purchase price of the goods, provided that only simple negligence exists on the part of us, our executive employees or our vicarious agents.

6.8
The limitations of liability in clause 6.7 do not apply if a cardinal obligation has been breached or in the case of personal injury.

6.9
If we are entitled to claim damages in lieu of performance, we may demand a flat-rate compensation of 20% of the agreed purchase price without proof of actual damages. The amount of damages will be adjusted upwards or downwards if we can prove higher damages or the customer can prove lower damages.

7. Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

You must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. by post, email or orally by telephone).

You can use our cancellation form for this process, but it is not mandatory.

Consequences of the revocation

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties and functionality.

8. Exchange & Return

If you are not satisfied with a product or would like to exchange it for a different size, you have the right to return your goods within 14 days.
