Scope of Application The following terms and conditions apply exclusively to contracts concluded between us and the consumer (customer) via our online shop for the delivery of goods.
Contracting Party and Conclusion of Contract The purchase contract is concluded with Trigon Deutschland GmbH. The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation for you to submit a binding offer to us. You may initially place our items in a virtual shopping cart without obligation and correct your order at any time before submitting it. The contract is only concluded when you click the “Buy Now” button, thereby completing your order. You will receive an email confirming receipt of your order. All offers are valid while stocks last.

Retention of Title The goods remain our property until full payment has been received.
Liability
We are liable without limitation for intent and gross negligence. In cases of slight negligence, our liability is limited to foreseeable damages typical for this type of contract. We are not liable for slight negligence in the breach of non-essential contractual obligations.
Liability for fraudulent concealment of defects, the assumption of a guarantee of quality, claims under the Product Liability Act, and damages resulting from injury to life, body, or health remain unaffected. No reversal of the burden of proof to the disadvantage of the customer is associated with this.
No liability is assumed for damages resulting from improper handling, processing, or natural wear and tear.
The customer must grant us reasonable time and opportunity, by prior arrangement, to carry out repairs or replacement deliveries.
Before withdrawal from the contract or reduction of the purchase price, the customer must grant us a reasonable period to remedy the defect.
To the extent that our liability is excluded or limited, this also applies to the personal liability of our employees, staff, representatives, and agents.
If we are liable due to a breach of duty giving rise to a claim for damages in lieu of performance pursuant to Sections 281, 282, 284 of the German Civil Code (BGB), or due to tort, such liability is limited to a maximum of the agreed purchase price of the goods, provided only simple negligence is involved on the part of us, our executive employees, or our agents.
The limitations of liability do not apply in the event of a breach of a fundamental contractual obligation or in cases of personal injury.
If we are entitled to claim damages in lieu of performance, we may demand, without proof of actual damage, 20% of the agreed purchase price as lump-sum compensation. The compensation amount may be higher or lower if we can prove greater damage or the customer can prove lesser damage.
Right of Withdrawal You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you (who is not the carrier) took possession of the goods.

Consequences of Withdrawal If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notice of your withdrawal. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise. In no event will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever occurs first. You must return or hand over the goods without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal. The deadline is met if you send the goods before the fourteen-day period has expired.

You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods if this loss in value is due to handling beyond what is necessary to examine the nature, characteristics, and functioning of the goods.
Exchange & Returns If you are not satisfied with a product or wish to exchange it for a different size, you have the right to return the goods within 14 days.
